5. Products, Pricing, and Orders

  • Product Description: We strive to ensure accurate product descriptions and vivid imagery. However, due to varying screen resolutions, the colors and textures you see on your device may differ slightly from the actual product. We do not warrant that product descriptions are entirely error-free.

  • Pricing: All prices listed on the Platform are in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. Prices and availability are subject to change without notice.

  • Order Acceptance: Your receipt of an electronic order confirmation does not signify our acceptance of your order. We reserve the right at any time after receipt of your order to accept or decline your order for any reason. Our acceptance of your order is confirmed when the product is dispatched to you. We reserve the right to cancel orders due to inaccuracies in pricing or product information, or due to unavailability of stock.

7. Intellectual Property Rights

All content included on the Platform, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Girlbasket or its content suppliers and is protected by Indian copyright and trademark laws. The compilation of all content on this Platform is the exclusive property of Girlbasket.

8. User Conduct and Submissions

If you post reviews, comments, photos, or other content, you grant Girlbasket a non-exclusive, royalty-free, perpetual, and fully sublicensable right to use, reproduce, modify, adapt, publish, and display such content throughout the world in any media. You represent that you own or control all rights to the content you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity.

You agree not to upload, host, or display any information that is harmful, harassing, blasphemous, defamatory, obscene, invasive of another's privacy, hateful, or racially/ethnically objectionable.

9. Disclaimer of Warranties

The Platform and all information, content, materials, products, and services included on or otherwise made available to you through the Platform are provided by Girlbasket on an "AS IS" and "AS AVAILABLE" basis, unless otherwise specified in writing.

Girlbasket makes no representations or warranties of any kind, express or implied, as to the operation of the Platform or the information, content, materials, or products included on it. You expressly agree that your use of this Platform is at your sole risk.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Girlbasket, its directors, officers, employees, or agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of, or inability to use, the Platform or the products purchased through it, even if Girlbasket has been advised of the possibility of such damages.

11. Indemnification

You agree to indemnify, defend, and hold harmless Girlbasket and its affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Platform.

12. Governing Law and Jurisdiction

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts located in New Delhi.

13. Changes to Terms of Service

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our Platform following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
